  5. IMPORTANT-READ CAREFULLY:  This SpiralCom End-User
  6. License Agreement ("EULA") is a legal agreement
  7. between you (either an individual or a single
  8. entity) and SpiralCom Communications Inc. for using
  9. the evaluation version of WinTAR-SCSI (the
  10. "SHAREWARE PRODUCT" or "SHAREWARE"). By installing,
  11. copying, or otherwise using the SHAREWARE, you
  12. agree to be bound by the terms in this EULA.
  13.  
  14. PART I - SHAREWARE PRODUCT LICENSE
  15.  
  16. The SHAREWARE PRODUCT is protected by copyright
  17. laws and international copyright treaties, as well
  18. as other intellectual property laws and treaties.
  19. The SHAREWARE PRODUCT is licensed, not sold. This
  20. agreement shall be governed by the laws of the
  21. Province of British Columbia, Canada.
  22.  
  23. PART II - TERMS APPLICABLE TO SHAREWARE VERSION
  24. GRANT
  25.  
  26. You are hereby licensed to:
  27.  
  28. 1) use the SHAREWARE for a thirty (30) day
  29.    evaluation period;
  30. 2) make as many copies of the SHAREWARE and
  31.    documentation as you wish;
  32. 3) give exact copies of the original SHAREWARE to
  33.    anyone except as noted in the EXPORT section;
  34. 4) distribute the SHAREWARE and documentation in
  35.    its unmodified form via electronic means.
  36.  
  37. There is no charge for any of the above.
  38.  
  39. You are specifically prohibited from:
  40.  
  41. 1) charging, or requesting donations, for any such
  42.    copies, however made, and from distributing the
  43.    SHAREWARE and/or documentation with other 
  44.    products commercial or otherwise without prior 
  45.    written permission;
  46. 2) modifying, translating, reverse engineering,
  47.    decompiling, disassembling (except to the extent
  48.    applicable laws specifically prohibit such
  49.    restriction), or creating derivative works based
  50.    on the SHAREWARE;
  51. 3) copying the SHAREWARE other than as specified
  52.    above;
  53. 4) renting, leasing, granting a security interest
  54.    in, or otherwise transfer rights to the
  55.    SHAREWARE;
  56. 5) removing any proprietary notices or labels on
  57.    the SHAREWARE.
  58.  
  59. Using the SHAREWARE after the thirty (30) day
  60. evaluation period is in violation of federal
  61. copyright laws.
  62.  
  63. EXPORT
  64.  
  65. By downloading, you acknowledge that the laws and
  66. regulations of the United States restrict the export
  67. and re-export of the SHAREWARE. Further, you agree
  68. that you will not export or re-export the SHAREWARE
  69. or media in any form without the appropriate
  70. United States and foreign government approval.
  71.  
  72. TITLE
  73.  
  74. Title, ownership rights, and intellectual property
  75. rights in the SHAREWARE shall remain in SpiralCom
  76. Communications Inc. and/or its suppliers.  The
  77. SHAREWARE is protected by the copyright laws and
  78. treaties.  Title and related rights in the content
  79. accessed through the SHAREWARE is the property of
  80. the applicable content owner and may be protected
  81. by applicable law. This EULA gives you no rights
  82. to such content.
  83.  
  84. TERMINATION
  85.  
  86. The EULA will terminate automatically if you fail
  87. to comply with the limitations described herein.  
  88. On termination, you must destroy all copies of the
  89. SHAREWARE and Documentation.
  90.  
  91. PART III - DISCLAIMER OF WARRANTY
  92.  
  93. THIS SOFTWARE AND THE ACCOMPANYING FILES ARE SOLD
  94. "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE
  95. OF MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER
  96. EXPRESSED OR IMPLIED. Because of the variety of
  97. hardware and software environments into which the
  98. SHAREWARE may be put, NO WARRANTY OF FITNESS FOR
  99. A PARTICULAR PURPOSE IS OFFERED.
  100.  
  101. Good data processing procedure dictates that any
  102. program be thoroughly tested with non-critical data
  103. before relying on it. The user must assume the
  104. entire risk of using the program.  ANY LIABILITY
  105. OF THE SELLER WILL BE LIMITED EXCLUSIVELY TO
  106. PRODUCT REPLACEMENT OR REFUND OF PURCHASE PRICE.
  107. NEITHER THE AUTHOR NOR SPIRALCOM COMMUNICATIONS
  108. INC. SHALL BE HELD LIABLE FOR ANY KIND OF DAMAGES
  109. OR CLAIMS THAT DIRECTLY OR INDIRECTLY RESULT FROM
  110. USING THIS SHAREWARE.
